BrandVoice AI is a social media content generation and management platform that uses artificial intelligence to help fashion brands create, optimize, and publish content across multiple social media platforms including but not limited to TikTok, Instagram, Facebook, and Twitter.

3. User Accounts

You must create an account to use our Service. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Ensuring your account information is accurate and up-to-date
• Notifying us immediately of any unauthorized use of your account

4. Subscription and Payment

BrandVoice AI offers subscription-based services with different pricing tiers. By subscribing, you agree to:

• Pay all fees associated with your chosen subscription plan
• Automatic renewal unless you cancel before the renewal date
• Our right to change pricing with 30 days notice
• No refunds for partial months or unused services

5. Social Media Account Connections

When you connect your social media accounts to BrandVoice AI:

• You grant us permission to post content on your behalf
• You retain all rights to your content
• You are responsible for compliance with each platform's terms of service
• We store access tokens securely but cannot guarantee absolute security
• You can disconnect accounts at any time

6. Content and Intellectual Property

Your Content: You retain all rights to content you upload. By using our Service, you grant us a license to process, store, and display your content solely to provide the Service.

AI-Generated Content: Content generated by our AI based on your inputs is yours to use. However, you are responsible for reviewing and approving all AI-generated content before posting.

Our Platform: BrandVoice AI, including its design, features, and code, is protected by copyright and other intellectual property laws.

7. Acceptable Use Policy

You agree NOT to use our Service to:

• Post illegal, harmful, or offensive content
• Spam, harass, or engage in abusive behavior
• Violate any social media platform's terms of service
• Infringe on others' intellectual property rights
• Attempt to hack, disrupt, or reverse engineer our Service
• Use the Service for any automated or bulk posting that violates platform policies

8. AI-Generated Content Disclaimer

Our AI generates content suggestions, but:

• You are solely responsible for reviewing and approving all content before posting
• We do not guarantee the accuracy, quality, or appropriateness of AI-generated content
• AI-generated content may occasionally contain errors or inappropriate suggestions
• You agree to review all content for compliance with laws and platform policies

9. Service Availability

We strive to maintain high availability, but:

• We do not guarantee uninterrupted or error-free service
• We may suspend service for maintenance with or without notice
• We are not responsible for failures caused by third-party platforms (TikTok, Instagram, etc.)
• Social media platform API changes may affect functionality

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• BrandVoice AI is provided "AS IS" without warranties of any kind
• We are not liable for any damages arising from use of the Service
• Our total liability shall not exceed the amount you paid in the past 12 months
• We are not responsible for content posted to your social media accounts
• We are not liable for account bans or suspensions on third-party platforms

11. Termination

We reserve the right to:

• Suspend or terminate accounts that violate these Terms
• Terminate accounts for non-payment
• Discontinue the Service with 30 days notice

You may cancel your subscription at any time through your account settings.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.
